Have you received and paid for a penalty charge notice for a bus lane contravention from Lambeth Council on the A2217 Clapham Park Road?

If you did before 21st December 2009 then you may be entitled to a refund.

In January 2009 I got a PCN on this road. I spent a year querying it (obtained from manually-operated CCTV — camera number 139) for a whole bunch of reasons (you don’t have to be an expert on these things to see a ton of things wrong with the whole set up). I finally received confirmation that the bus lane was non-compliant on 16th March 2010 and did not have to pay the charge.

The letter from Lambeth council outlined why they originally thought I was in breach of the law but then went on to state:

This [referring to the original decision to PCN me] was also the council’s position until 21 December 2009. The Council had commissioned an independent review of the Clapham Park Road bus lane by WS Atkins Consulting following a number of complaints and contradictory rulings by PATAS. In summary the result of the review was that the bus lane was not enforceable due to technicalities relating to length of the entry taper and the positioning of signage.

I’m not sure about tapering but if you go to google maps you can clearly see that the sign in question as you approach the bus lane does not state hours of operation. Now there is some debate as to whether that means a driver is to assume that the hours of operation are therefore 24×7. If not, then the sigange is indeed wrong but if so, and we are to assume in the absence of any times that it’s 24×7, then there is vast inconsistency throughout Lambeth borough and, I suspect, the whole of London. In fact this signage on Clapham Park road is the only example I can find of a 24×7 bus lane operation where the signage does not explicitly state this and if you drive on a bit further down Acre Lane you will find similar signage which states the hours of operation as being 24 x 7 excluding Sundays. There are other examples all over Lambeth where 24×7 is indicated by the phrase “At All times” and other such wording. This inconsistency will stand you in good stead if you wish to appeal.

If you are thinking of engaging a council in correspondence you might be interested to know:

  • I had to do it via the Local Government Ombudsman as the council, without informing me,  passed my own letters onto a 3rd-party agency called Astron who simply sent unsigned acknowledgements in reply to each letter. As yet, Astron have not replied to a single letter.
  • Don’t complain about the lack of response to the council’s complaints manager. In my case he simply passed my complaint onto the Lambeth traffic Department who passed it on to Astron — I got the standard ack in reply.
  • Even if you are penalised on this road post 21/12/09 then you should still appeal. This notorious south London junction has a lot of things that mitigate any bus lane contraventions: not least the fact that because of the complex layout you, the driver, are forced to take a right-hand fork in order to turn left, something which comes very unnaturally to most drivers and is yet to be tested in front of a magistrate as far as I know.

6th August 2010

We suspended enforcement of this on 21/12/09 to carry out remedial works to the signs and lines. Enforcement recommenced on 22/01/10.  During this time no Penalty Charge Notices (PCN) were issued.

Although the signs and lines needed improving at this location the vast majority of drivers complied with the regulations and did not enter into the Bus Lane. Any motorist who received a PCN had the opportunity to challenge it within the statutory procedure at the time.  Although we had no legal obligation to reopen cases, we have reconsidered, on a case by case basis, any correspondence we received from a motorist who previously challenged the PCN on the grounds the signage was inadequate or confusing.

    Charlotte – sounds to me like this is the second notice they are sending you and the first one (where they would have charged £65) didn’t make it to you. I would offer to settle at £65 (or less) and say if they want to have £130 they will have to prove that you received their first letter (unlikely they will be able to do that).

    Mike – sadly they are never going to do anything eminently sensible (unless MPs get involved or such like) as, quite simply, they are making far too much money.

    Tom – I (almost) feel your pain. I got two, makes me so angry. The fact that you went in the “bus lane” three times in one day just emphasises the fact that the signs are completely inadequate.

    As a PS to my 15 June – turns out Lambeth Parking must have banked my cheque by accident, and they are still chasing me for one of the PCNs (but have dropped the other). I have referred them to the settlement offer and stated that the matter is now closed. Upshot is that it is worth appealing, sending a cheque for a smaller amount, stating that by banking the cheque they are accepting your offer in full and final settlement, and hoping they bank it by mistake.

    Hi infortunate all, I went in the same bus lane at the same place on nov 12 (cam LW0011).
    It’s good to see I’m not the only one… although that sounds wrong. I needed some help So I websurfed and found this website. I m homeless living in my vehicle and just starting to get back on track (after 2 years depression breakdown). A friend of a friend agreed to let me use his address to insure and register my van but he never told when I got the PCN letters. Instead of 65£ I now have to pay 190£. The friend of friend s now moving out. I have found another person who kindly let me use his address and will soon do the changes. However I only managed to make enough money to pay for road tax, MOT, insurance fee (increased with address change) expenses. I cannot pay 190£ on top. I already have nothing left for food. If I could get the amount to pay back down to 65£ I could try to borrow that. Any help appreciated. So sick of struggling double because noone of those supposed to support helping.

    So clearly there to trip you up, it would help if they painted it Red!! BUt they might get no money as it would be obvious.
    I am unemployed single mum and cannot afford it but paid it just to save the hassle. That is why they do it, I hate it.

    Who remebers when you could park without paying, drive a ‘little’ fast accidently and not pay. HELP the world is controlled by money making machines and greedy people, no room for human error.

    CAN YOU BELIEVE THIS! Kingston got me for parking on my own drive in a cul-de sac with their new touring cars! apparently didn’t leave enough space on the pavement for a wheel chair even though their new lamp post leaves less space for one! I got whole street to sign and still had to pay. And I was putting it on drive so a neighbour could park in front of my drive while I was on holiday. A nice welcome back to England!

    I have just received a PCN for this same junction! My fine is for £130, so have clearly not been sent the previous letter for £65?!

    I live in south kent and only go to clapham a couple of times a year to see my friend, I always drive the same ways here and back, which is nowhere near this junction, but on the day of my alleged offence it was the London marathon, so I had to find an alternative route to get myself home! I was also following my sat nav, I didn’t see any signs for it being a bus lane and the Tarmac was not red!!! So annoyed as I always make sure I never go near the bus lanes!

    I am going to try and appeal……fingers crossed!!

    I also got done on 22nd July – at 05.32am!!

    I am doing the Knowledge of London and was obviously checking my map to see if I had to turn left or go straight on, and missed the ONE sign they have in place (I’ve checked it on Google StreetView) and they snapped me! There wasn’t another car on the road at all, but Lambeth obviously see it as a good money making system, so enforce this ridiculous restriction despite most other bus lanes being in operation until 07.00.

    It’s a complete scam, but doesn’t surprise me unfortunately. £65.00 down the toilet!

    Got done on 03/08/2013 a total scam I didn’t even notice it at all as I am unfamiliar with the area and with a camera hidden in the trees I had no chance. I was simply following the sat nav, why is the lane not marked in RED????? with the success of this junction in generating huge revenue for the council it is clearly obvious that something is wrong, the markings are not clear and more should be done but I bet the council will not favour that as it is there money making machine…..

    Me too! I do not live in London and was being very careful in general… last time I went there the road layout was different. I can’t believe that I went in a marked up bus lane with the times on it – I always check! and then, if it was a proper bus lane, how else was I going to turn left? following satnav, I had to take next left not go straight on…. how could I know that there was a left turn still available to cars after the filter lane but to see it you have to go straight on first… I cannot afford this fine and I really resent having to pay it. I got stuck in London that weekend and could NOT leave for 4 hours due to all the bridges being closed for the London Ride…do I stand a chance if I appeal? grrrr.

    Blast it!! Just found the PCN on the doormat, I’ve been caught out by this one (LW0011 on Clapham Park Road) while taking SWMBO and her daughter to see her son who’s moved to Clapham, on October 6th. The video clip for my case shows I came up the bus lane all the way, but driver of the car in front of me will be cursing even more, they cut into it at the last minute at the lights. What really annoys me is that the only other two times I’ve ever been that way, I’ve obviously spotted the setup and taken the left turn from the middle lane, since I got no PCNs then. I really do hope that this time it’s just my complete oversight, and that I wasn’t being distracted by daughter’s usual relentless chuntering from the back seat.     I got caught on a Sunday, was in the wrong place couldn’t get into the central lane the photo shows I had no where to go due to other vehicles.

    So, should stop and wait till the other cars move on the change of the lights, or progress forward so not to become a hazard at a junction.

    What if i just remained stationary waiting to get out of the bus lane would i have got fined as blocking the bus lane or being a hazard near a junction. You can just imagine the reviewer watching the CCTV rubbing his grubby hands to make the councils richer.

    Amazing how when you get lost and trying to find a route and pay attention to all the other crap on London streets they expect you to be looking for badly marked, badly sign posted bus lanes on a main road junction.

    Not to mention that the Roads are supposedly funded by ROAD TAX and they don’t want you driving on it without taking your picture and giving you a fine.

    Maybe we should send them fines when the buses block the main carriage way because the big red bus driver thinks he owns the road and cant manage to pull in to the bus stop markings stopping 4ft from the curb.

    Welcome to RIP OFF BRITAIN, where if the government don’t screw you for your hard earn cash the councils will be more than happy to take whats left in your already empty pockets.

    At least you knew you was being robbed by the highwaymen but these councils use cameras instead of guns and rob you a week later.

    Just got done by same camera LW0011, and at 08;32 on a Sunday morning. With scarcely another car on the road WHY is a bus lane operating? It makes NO difference to the speed of a bus. The camera is obviously a money-maker for Lambeth Council. I am thinking about a freedom of information request to find out how much revenue they get from it. Bastards. Bastards. Bastards.

    I have also got done by this camera. Heavy rain, a bus just in front of me so the sign was invisible, no red marking, and the road guiding me to the left. What is name and address of one person on Lambeth Council who might agree to defend this con job or overturn it? When local elections are next held, I hope the bastards are at least grilled on this little bit of extortion.

    One of my drvers got a PCN turning left at this junction. As he lives in Manchester he is not aware of the junction and was follwoinganother car and his sat navigation.This bus Lane camera issued 16582 PCNs in the past twelve months. Thats three times more than any other camera operated by Lambeth Council. It is very clear that this is becasue the design on the junction is very confusing and a white arrow on the road showing turn left adds to this.Assuming that everyone paid the £65. That over a millon pounds per year. As Iam sure that a nuymber of people did not so the fee would be £130 or even £202. So the figure s probably more like 2 millon pounds. Thats not acceptable. I intend to write to the newspaper, Lambeth council, my MP and to the department of transport and I suggest everyone else should do the same.

    Just arrived home today to find a similar fine from camera Lw0011. I think its grossly unfair. I too am new to London and believe I was following my satnav at time. I am a careful motorist who tries to obey laws at all time. This junction was throughly confusing and I made a genuine mistake and 11pm at night with no other traffic in sight! . Why as so many others have said is the bus lane not red and the signage not better. As am upstanding citizen I am disgusted at being criminalised for a genuine momentary mistake which I believe is clearly down to poor signage. Lambeth council disgust me. I am very disappointed by the whole thing. I agree with the sentiments of all – modern day highway robbery.

    I got caught by this camera. Sat nav said turn left. I saw it was a bus stop but nothing at that point to say it was a bus lane until it’s too late. The thugs of Lambeth council will get their just deserts in hell, if not before.

    I remember feeling confused about this road layout as I drove it….however…, I know I wasn’t there at this time, it was Mothers Day and I was visiting in Hertfordshire!

    We received a PCN for this location and appealed successfully. We won because of a technically based on the Council’s failure to send in the correct details/forms. Always worth a go! In the process, we asked by a Freedom of Information Act request what the total number of cameras was for the borough and what % of income was generated by this one speed camera. The answer (2013) is that this camera is one of 36 cameras, therefore represents 3% of cameras, but accounts for 60% of income! It’s just one big money spinner so no wonder the Council don’t highlight the camera better. Carry out your own request for free, just write a letter.

    I’ve received THREE pcns from the evil LW0011 this week, one for each day I was using this route to get to a job. I don’t live in London but I’m aware of the bus lane scam and always keep an eye out for them. The fact that I failed to notice this one three days running says everything that needs to be said. If any of us tried the same underhand scam we’d be arrested!

    I’ve thought about appealing but note that they’ve made all the necessary changes to signage and lines, etc., so it would be an appeal for leniency based on my quite innocent straying into a very difficult to notice bus lane. I doubt if it will fall on sympathetic ears though, so sod it – here goes £195 of the measly £200 I earnt!

    We have no knowledge of the area and we have just been issued with a PCN after following our sat nav!!! There were two of us in the car at at no point did we notice that this was a bus lane…..we have appealed but expect the same old drivel back. However; does anyone know the times that this is the bus lane and on a Sunday? This is a clear cash cow……and feel that the signage needs to be clearer for the left turn…..any help will be welcomed!!!!

    Wow a lot of comments from drivers that don’t seem to pay attention when they’re driving! I’ve driven in London for years and the only ticket I’ve got was camera issued for driving in a bus lane (near Brixton but not this one) BUT I had pulled over to let a police car pass, legally the wrong thing to do but luckily my employer agreed to pay. I have issues with camera issued tickets where they are issued wrongly or where signs are badly placed/confusing, but I know this junction and the bus lane sign is clearly visible. A number of people seem to be blaming “following their sat nav!!!” A sat nav is not a substitute for eyes and a brain!. Getting off on a technicality such as no times on the bus lane sign is fair enough I guess but if there were no times shown surely any sensibly driver would assume the worst that it was 24hr and not take the risk? I know I would. Perhaps more people should concentrate on driving rather than what they’re going to have for dinner etc. etc.

    I’ve just been caught by this camera. I’ve never ever had a pcn before. Always really careful not to go into bus lanes. This was issued at 1.49am on dec 27th 2014 coming back from a Boxing Day visit with friends completely sober. No traffic on the road at all,no clear signage, no red bus route markings on the road. Dark and the road was closed to any traffic from the A3 so no buses. i’m furious it’s obviously a complete scam that catches out motorists left right and centre, if the council were honest about it they’d make this junction more obvious. the Sheer record numbers of drivers being caught out by this is absurd. It obviously isn’t just an issue of arrogant drivers and it’s stupid of people to assume this given the evidence. Any advice about this? Obviously a total cash cow for Lambeth.

    Has anybody actually driven in this lane and not received a ticket ? I went through a few weeks ago and only realised at the very last minute what I had done . I’m hoping that the camera was not being monitored or was not working at this time . It was 1am in the morning on a Friday night with no other cars on the road. Clearly I did not try to gain any advantage in using the lane but simply got confused with the sat nav telling me to turn left and the road forking to the right.

    Annoyed to see that they are still making money out of this, years after my fine (which I did get off in the end). I have ended up going to PATAS for another incident in another “cash cow” spot where PATAS agreed with me that the signage falled short of the Traffic Manual guidance. I’m going to see if the same newspaper that reported on this particular cash cow hot spot wants to (anonymously) run the story. It’s a disgrace that so many people are being fleeced so unfairly.

    Martin – noone (I know) would knowingly use a bus lane in London. It’s not worth £65, esp in this case, where there is no benefit in using what appears to be a slip road to turn left, given the traffic lights. It’s clearly a money making scheme and not a traffic control measure. If the Council really meant it to be the latter, they would add additional no entry signs to make it clearer, and remove the white left arrow sign from the road that suggests cars should go into a slip road. (What Sue said). Do you work for Lambeth or something??!

    It suggests that Lambeth know only too well they are being dishonest as they don’t seem to want the matter to go to PATAS – they appear to back out before it goes that far. If they let it go to PATAS, they risk getting a judgment against them which could then be cited by the tens of thousands who get caught each year in their appeals (if they happen to know about it).

    There was no sign where Mr Chapman entered the bus lane indicating that he was entering a bus lane. The image submitted by the Council of a bus lane sign and the legend in the road were further back down the road. Mr Chapman crossed over to make a left hand turn at the traffic lights with no warning that he was entering into a bus lane. He saw only the green filter lights indicating what he believed to be a permitted left hand turn. The only bus lane warning was a tiny circular sign beneath the green filter light. A motorist could not hope to see that sign before it was too late to avoid the left turn. It was “too little too late”. The signage was not in my view adequate to warn a motorist against a left hand turn into the bus lane.

    I also became a victim of this scam. photo was taken on the 28th Feb @ 20:28 hrs & the notice posted on the 25th March.
    Next to the photos they also show a short video footage on their website. I also had a quick look on google / street view in order to understand what went wrong. I did not know the area. Heavy rainfall that night… how is somebody supposed to know that you should drive straight forward in order to turn left? a car was driving in front of me – i was driving behind it and based on this I could not even see that the turn was marked “bus lane”. On the video footage the car in front of me is visible, followed by me – and i could still see three other cars following “us” on the bus lane, seconds afterwards before the video stopped. What to say – there is definitely something wrong that at least 4 tax paying citizens get caught within less than 15 seconds at the same place. what to do? As i am driving a company car the leasing company automatically pays all fines which is considered as an admission of guilt by the highway robbers of Lambeth.

    I also received a PCN for ‘Being in a Bus Lane’ at 20.11 on 28 February 2015. I sent a cheque for £65 with the intention of looking into appealing and cancelling the cheque if I thought it was worth doing so, but it appears Lambeth Parking banked the cheque swiftly, they can move when they want to. There needs to be a highly visible sign showing the route around the bus route to stop any more unfortunate victims of Lambeth Council. Surely the bus lanes were introduced to control traffic at peak hours, why would they be necessary 24 hours a day or at 20.11 on a Saturday night?

    Am I right in thinking people have still been appealing these or just paying the fines?
    I am totally unfamiliar with this area as I live 200 miles away. Please could anyone give me any more info regarding the lack of signage, etc as I would like to appeal and not just cough up for what seems to be another council “money making scam”!

    Returned from holiday to find a Lambeth Notice on the doorstep….same bus-lane junction as shown above.
    Given the number of people that feel unfairly treated and given the amount of money Lambeth Council are making on this, I plan to appeal the decision. Does anyone know how the signs have changed over the last 2 or 3 years?

    yes I’ve just received a PCN for the notorious bus lane on Clapham Park Road.
    as others have said – I turned left without realising I should have gone straight on!
    I too am not familiar with the area and certainly not the confusing layout.
    I will be writing to them and hope they will cancel charges.

    I too was conned on this junction. I think the scam works because they have put a bus stop in the mouth of the junction. This makes it look like a bus stop and not a bus lane. That and the fact that they haven’t painted it a different colour.

    I see from trawling online that they have been scamming people for at least six years — with a few suspensions while ‘independent’ reviews absolved them from blame.

    Someone hit them with a freedom of information request to discover how many people are stung each year and it was a few hundred shy of 16,000. That’s at least £1000000 a year in income.
    Plainly, if 16000 people are being hit every year, then the signage cannot be adequate…

    I’m thinking of petitioning the Secretary of State to have their licence to issue statutory penalties revoked on the grounds that this act was never intended to be used for raising revenue.

    It would be an uphill battle…

    I’m also thinking of trying to raise funds for the fight on a crowd-funding site to pay for a top notch brief to take them on and force the Sec of State via the courts to take action.

    I’ve just recieved the same fine. I’m also not from the area so I wasn’t aware of the junction and I was also following my sat nav. I never seen any signs I think this is a really unfair penalty. Can anyone tell me if it’s worth appealing? Or is it better to just pay the 65pound fine? any help would be greatly appreciated.

    Yes I got caught too and will be appealing – over 200 appeals have been upheld by PATAS and many more are overturned before that stage. The problem is they have created a confusing hybrid between a bus lane and a bus gate and the signage is therefore wrong. There are a number of issues but the key oversight, which in my opinion invalidates the majority of the c10,000 PCNs issued annually, is there is an exemption in the Traffic Management order for this bus lane for drivers to enter the lane to turn left. The bus lane is only 70m long and it is obvious that drivers entering it are doing so to turn left. The road markings are wrong, the bus gate signs are too small and in the wrong position, and the arrow on the road directs you into the bus lane. Quote the exemption in your appeal. having had appeals upheld by PATAS because of the exemption and inadequate road markings they should not in my opinion continue to issue tickets unless the TMO is changed and the signs are corrected.

    URGENT HELP REQUIRED PLEASE

    I have just received notice of a PCN from this Proxy Junction Camera through the post today on 23/06/2015 with only one day left to pay the fine at £65 as it was issued on 10/06/2015. Royal mail cant be that bad surely!
    If I don’t pay today the charge goes up to £130

    Please URGENTLY kindly advise
    1) Has anyone here on the forum won an appeal in 2015?
    2) Do you have to appear in court?

    Please can you advise where the exemption in the Traffic Management Order for this bus lane for drivers to enter the lane to turn left is, I have looked at the link to the PDF you provided, but am obviously missing something. I would be grateful if you have an outline of your appeal that I can use.

    Hi Charles,

    I believe you can use the online appeal route for parking tickets on the Lambeth website to make your informal appeal. That should re-start the clock if you do it today.

    I am confident that you will not be paying a fine (£65 or £130) as you are allowed to turn left at this junction via the bus lane. The TMO link I posted has the exemption clause in it near the top of page 41/3 – the wording starts with ‘The controls specified in Article 3(1) do not apply………

    I have written to Councillor Brathwaite who is responsible for this area to ask her why PCNs are being issued for a manoeuvre that is permitted under the TMO for this bus lane. I suggest you do the same – her email is jbrathwaite@lambeth.gov.uk quoting the TMO exemption clause.

    I have not had the result of my informal appeal yet but when I submitted it I had not seen the TMO. The TMO exemption is the key show-stopper for PCNs imho however you can also mention the confusing and incorrect road signs and the fact that TfL ermit drivers to cross bus lanes to turn left where there is an arrow or dotted line.

    I have also just submitted 2 freedom of information requests that I intend to use in my formal appeal if it gets to that stage. Are you local to the area – if so we could meet up to discuss if you have time.

    I have also written to the Secretary of State for Transport about the general issue of PCNs being issued to drivers who cross bus lanes to turn left.

    I wish I had found this site before I paid up…Got a ticket for a bus lane contravention at 4.50 am on Friday 5th of June. There was a diversion which took us off the south circular and lead and lead us straight into the bus lane (even though we could see no markings for a bus lane)
    We had no reason to be there other than being forced away from Christchurch road by said diversion.

    So annoying.

    My son received a PCN for driving in a bus lane at 05:05 on 18 th June. The car is shown in the picture but there is no other traffic, the roads are empty and I am not even sure if the buses run at that time of the morning. Absolute rip off, Lambeth councililers should hang their heads in shame at taking money off of hard working people like this to fund their other f**k ups or their lavish lifestyles
